Arbitration Fee Schedule
Because Felicia appreciates that all cases are not alike, she builds flexibility into the arbitration fee schedule and is willing to adjust a fee depending on the complexity of the issues, the number of parties, the amount in controversy, and other relevant factors. However, the following is estimated to be an appropriate fee for most arbitrations.
Schedule of Minimum Fees per Arbitration Day (Monday through Friday)
Retainer
A retainer is required in advance of each proceeding, the amount of which is dependent on the factors mentioned above.
Expenses & Forum Fees
Depending on the location for a hearing, additional out-of-pocket reimbursable expenses may be incurred for hearing rooms, refreshments, working lunches, etc., which may be charged and divided equally among the parties to the arbitration.
Weekends
Subject to the agreement of all of the parties, and the availability of conference rooms, weekend hearings can be accommodated. The parties, however, may be required to pay an additional charge for administrative and other expenses incurred to make the accommodation.
Cancellation Policy
Because late cancellation of arbitrations causes a variety of problems for all concerned, the following late cancellation policy may apply. If an arbitration final hearing is cancelled 21 or fewer days prior to the scheduled start of the arbitration, a cancellation fee equal to the daily rate times the number of days cancelled may be charged to the cancelling party or parties, in the absence of valid reasons for cancellation such as illness or other unavoidable, unexpected, and uncontrollable circumstances.
Travel Expenses
For proceedings occurring outside of the general Houston region, parties may be required to reimburse actual travel expenses incurred for transportation (air and ground), meals, and hotel.
NOTE: This fee schedule does not apply to an arbitration assigned by and accepted through a Governmental agency.
